Experience

Ken is an AV rated (preeminent) attorney and has more than 30 years of experience handling construction claims, litigation, arbitration, risk management, and contract drafting/negotiation. Ken also has extensive experience with commercial matters, personal injury, wrongful death, product liability, premises liability, insurance coverage and fraud. In the construction industry, Ken has represented design professionals, owners, contractors, subcontractors, sureties, and suppliers and has handled virtually every type of claim arising from a commercial project, e.g., defects in all design disciplines, delay and impact, job site safety, wrongful termination, liquidated damages, cardinal change, differing site conditions, and other contract disputes.  Ken has also spoken on a number of construction issues, including mold claims, differing site conditions, OSHA matters, lien claims and other issues of interest to owners, contractors, and design professionals. He has also authored chapters for several construction law publications, including Missouri Construction Law published by The Missouri Bar, Kansas Construction Law published by Aspen Publishing and Construction Change Order Claims published by Wiley Law.

Representative Experience

Kenton (Ken) Snow recently concluded his representation of a Fortune 500 company in multiple cases involving a 2013 natural gas explosion that destroyed a Kansas City restaurant. The claims asserted by the various plaintiffs included claims for wrongful death, personal injury, and property damage that involved millions of dollars in damage. In one case, Ken tried a six-week jury trial involving more than 65 fact and expert witnesses. In that case, the plaintiffs received less than 20 percent of their last settlement demand and no punitive damages.

Ken represented another Fortune 500 company in a case involving construction defects at over 20 properties in 10 different states. In that case, Ken personally took over 100 depositions of fact and expert witnesses and attended multiple mediations before the case was resolved via a confidential settlement.

 

Ken recently represented an engineering firm in a multi-million-dollar dispute involving the design and construction of a large retaining wall in Oklahoma. After multiple depositions, Ken was able to resolve the matter on behalf of his client for less than 10% of the claimed damages.
